Terms of Service

By engaging Design HQ for any service or accessing this website, you agree to be bound by the following Terms of Service. Please read them carefully before proceeding.

1. Services

Design HQ provides brand identity, UI/UX design, motion graphics, web design, and related creative services. The specific scope, deliverables, timeline, and fees for any engagement will be outlined in a separate project agreement or proposal, which forms part of these terms once accepted.

2. Payment

• —A deposit (typically 50%) is required before work commences. The remaining balance is due upon project completion or as outlined in the project agreement.
• —Invoices are due within 14 days of issue unless otherwise agreed in writing.
• —Late payments may incur interest at 2% per month on the outstanding balance.
• —All fees are quoted exclusive of applicable taxes unless stated otherwise.

3. Revisions & Scope Changes

Each project includes a defined number of revision rounds as specified in the project agreement. Requests that fall outside the agreed scope — including additional concepts, new directions, or feature additions — will be quoted separately and require written approval before work proceeds.

4. Intellectual Property

• —Upon full payment, the client receives full ownership of the final, approved deliverables.
• —Design HQ retains ownership of all preliminary concepts, drafts, and unused work.
• —Design HQ reserves the right to display completed work in its portfolio and marketing materials unless otherwise agreed in writing.
• —Third-party assets (fonts, stock imagery, icons) remain subject to their respective licences, which the client is responsible for maintaining.

5. Client Responsibilities

The client agrees to:

• —Provide accurate briefs, brand materials, and feedback in a timely manner.
• —Ensure they hold the rights to any content, images, or assets supplied to Design HQ.
• —Respond to feedback requests within the timeframe specified in the project agreement. Delays caused by the client may affect timelines and incur additional charges.

6. Cancellation

If a project is cancelled by the client after work has commenced, the deposit is non-refundable. Any work completed beyond the deposit value will be invoiced at the agreed rate. Design HQ reserves the right to terminate an engagement if the client is in breach of these terms, with fees for completed work remaining due.

7. Limitation of Liability

Design HQ's total liability for any claim arising from a project shall not exceed the total fees paid for that project. We are not liable for indirect, incidental, or consequential damages, including loss of profit or business opportunity, arising from the use of our deliverables.

8. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information disclosed during the engagement. This obligation survives the termination of the project agreement.

9. Governing Law

These terms are governed by applicable law in the jurisdiction where Design HQ is registered. Any disputes shall be resolved through good-faith negotiation before resorting to formal legal proceedings.
